Consignment terms

These terms govern the consignment service at consignment.getmangahub.com, where I sell graded manga and magazines on your behalf. They are between you, the owner of the items, and me, the operator of MangaHub, based in Spain.
By sending the submission form you accept these terms. If you do not accept them, do not send the form.
They are separate from the MangaHub app terms. Using the app does not put you under these terms, and consigning with me does not require an app account.
1. What this service is
I find a buyer for an item you own, agree the price with you first, handle the listing, the questions and the negotiation, take the buyer's money, and then tell you where to send it. When the buyer confirms the item arrived as described, I transfer your share.
I am not an auction house, an escrow provider, a payment institution or a shipping company. I am a seller acting on your behalf, and the arrangement below is what that means in practice.
I accept manga volumes and Japanese magazines that are already encapsulated and graded by Beckett (BGS). I do not accept raw or ungraded copies, and I do not currently accept items graded by any other company. If you send something outside that scope through the form, I will tell you and take it no further.
2. Sending me a submission
The form asks who you are, where your items are, what you hold and what you want for it, and it requires at least 3 photographs of each item, up to 6. A single submission carries up to 15 items.
You confirm that you own the items outright, that they are yours to sell, that nobody else has a claim over them, and that they are not the subject of any dispute, loan or security.
You confirm that the photographs are of the actual items you are offering, taken by you or with permission, and that the grade shown on the label is the real grade of the copy in the photograph.
Sending a submission does not create a sale and does not oblige me to list anything. I review each one and may decline any item or any submission without giving a reason. I will tell you either way.
3. Pricing
You choose how each item is priced. Either you set the asking price and tell me the maximum discount I may accept, or you ask me to price it to the market, in which case I research comparable sales and come back to you with a figure.
Nothing goes live until you have seen and agreed the price. I will not accept an offer below the floor your maximum discount sets.
The listing price I record may differ from what you originally asked for. That is the number we agreed, and it is the number the commission is calculated on.
I sell at a fixed price. I do not run auctions.
4. Listing
Once we have agreed pricing, your items go live within 7 days of your submission. If something in your lot needs more research than that allows, I will tell you before the deadline rather than after it.
I choose the platforms. I sell through curated marketplaces and my own channels, and I may change where I list without notice, provided the agreed price and the agreed discount floor are respected.
5. Commission
I am paid only when an item sells. There is no submission fee, no listing fee, no fixed deduction and no marketplace fee passed on to you. If an item does not sell, you owe me nothing.
My commission is a percentage of the final sale price of each item, on the scale set out below. The scale applies per item, not per submission, and the band is decided by what that item actually sold for.
Prices in the scale are US dollars. Where a sale settles in another currency, the band is decided by the equivalent value at the exchange rate on the day the buyer pays.

6. You keep your items until they are paid for
You do not send me anything. Your items stay with you for the whole time they are listed.
When a buyer commits, the buyer pays me first. Only once that money has cleared do I send you shipping instructions and the buyer's delivery details.
You then post the item directly to the buyer, within a reasonable time of receiving those instructions and no later than 5 business days unless we agree otherwise.
The buyer pays the cost of shipping. You are not out of pocket for the postage.
You must send the item using a tracked service with insurance covering the sale value, and you must give me the tracking number. If you post it untracked or underinsured, the risk of anything that follows is yours.
7. Confirmation and payment
When the buyer confirms the item arrived as described, that releases your payment.
If the carrier records the item as delivered and the buyer raises nothing within 7 days of that delivery, the item is treated as accepted and your payment is released anyway.
I transfer your share, being the sale price less my commission, within 5 business days of that release, by a method we have agreed. Any bank charge levied by your own bank or an intermediary bank on an international transfer is yours.
You are responsible for your own tax. I do not withhold, declare or advise on tax on your behalf, and what you owe on a sale is between you and your tax authority.
8. Pulling an item
You can withdraw any item at any time before a buyer has paid for it, for any reason, at no cost. Tell me and I take it down.
Once a buyer has paid, that sale is binding and the item must be sent. If you refuse to send an item a buyer has already paid for, I will refund the buyer, and I may decline to work with you again and recover from you any cost that refusal causes me.
I can also stop listing an item or end this arrangement at any time, and I will tell you if I do.
9. When something goes wrong
If the buyer says the item is not as described, I hold the money until it is settled. I mediate using the photographs and the description from your submission, which is why those have to be accurate. If the complaint is upheld, the item is returned to you at my or the buyer's cost depending on where the fault lay, and the sale is unwound.
If the item is lost or damaged in transit, I refund the buyer. The claim against the carrier is yours to make, because the contract of carriage is yours, and I will give you the evidence of the sale value you need to make it. This is why the tracked and insured service in clause 6 is a requirement and not a suggestion.
If a buyer's payment is later reversed by their bank or payment provider through no fault of mine, and I have already paid you, you agree to return the amount I paid you.
10. Customs and cross-border sales
I ask where your items are because customs and duties depend on the country, not the region. You must tell me accurately, and tell me if it changes.
Where a sale crosses a border, you are the sender. You are responsible for completing customs documentation truthfully and for complying with the export rules of your own country. I will tell you what the destination requires, but I cannot complete those declarations for you and I will not describe a sold item as a gift or understate its value.
Import duty and taxes are payable by whoever receives the parcel, which is the buyer. They are never charged to you and they are never deducted from your payment. Any penalty arising from a declaration you made incorrectly is yours.
11. What I am responsible for
I am responsible for doing what these terms say: pricing with you, listing within the stated window, handling the buyer, holding the money until the sale completes, and paying you on time.
I am not responsible for the condition of your items, for the accuracy of a grade assigned by Beckett, for what the market decides an item is worth, or for anything that happens to a parcel once you have posted it.
Nothing in these terms limits my liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Spanish law. Subject to that, my total liability to you for any item is limited to the sale price of that item.
12. Your information
What I collect through the submission form, why, and how long I keep it, is set out in the MangaHub privacy policy. In short: your contact details and your photographs are used to price, list and complete the sale, the photographs are stored privately and are not published as they were sent, and I keep a one-way keyed hash of your IP address to protect the form from abuse rather than the address itself.
I share your name and delivery details with the buyer only to the extent a shipment requires it.
13. Changing these terms
I may update these terms. The version that applies to a submission is the version published when you sent it, and a change never applies retroactively to an item already listed or already sold.
If I make a material change, I will tell you at the address you gave me before it affects anything of yours that is still live.
14. Law and disputes
These terms are governed by the laws of Spain and the European Union. If you are a consumer resident in the European Union, you also keep the protections of the mandatory law of your own country, and nothing here removes them.
If we disagree, contact me first at contact@getmangahub.com and I will make a genuine effort to resolve it. If it is not resolved within 30 days, it goes to the competent courts of Spain.
